Premise

This information is provided pursuant to art. 19 of the Federal Act on Data Protection (hereinafter “LPD”) and, where applicable, art. 13 and 14 of Regulation (EU) 2016/679 (hereinafter “GDPR”) by Auxilia Real Estate Sagl (hereinafter “Auxilia”) in relation to the data processed via the company website www.auxiliarealestate.ch and related third-level domains (hereinafter “Site”).

Definitions and scope of the information

For the purposes of this information, “personal data” means any information that directly or indirectly allows the identification of a natural person (hereinafter “Data Subject”). Processing is defined as any form of operation relating to personal data such as collection, storage, use, communication, archiving or deletion.

The data covered by this information are collected through the Site during navigation, when the user registers or makes purchases or when he/she fills out a form on the web pages. Each individual form is associated with specific detailed information that can be consulted at the link shown under the form of interest to which, for the individual specific treatments, reference is made.

Data controller and contact details

The data controller of the personal data (hereinafter “Controller”) subject of this information is Auxilia Real Estate Sagl. Categories of data subject to processing

The following categories of personal data are processed through the Site:

  1. Traffic data and logs: the computer systems and software procedures used to operate the Site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. The site is created with a content management system (CMS) installed on web servers provided by third parties and may communicate data strictly necessary for operation to the latter. This category of data includes the IP addresses or domain names of computers and terminals used by users, the URI/URL (Uniform Resource Identifier/Locator) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server and other parameters relating to the operating system and the user’s IT environment.
  2. Personal data for contact form: name, surname, physical address, nationality, municipality of residence, landline and/or mobile telephone, email address and similar.

The optional, explicit and voluntary sending and forwarding of the forms on the Site entail the acquisition of the sender’s contact data; for each individual information collection form, specific information is published to which reference is made.

Purposes and legal bases of the processing

The Data Controller processes user data for the purposes indicated below with the respective legal bases:

  1. Request for information: to carry out the preliminary activities of personal registration necessary to make purchases or to carry out your request for information and/or contact, as well as to fulfill any other related obligation. Legal basis: consent of the interested party.on the respective legal bases:
  2. Promotional and marketing activities: for the authorization to send, with specific consent, communications of promotions and offers of the Owner’s Products through newsletters and SMS. Where the legal basis of the processing is based on consent, the Data Subject may revoke it at any time simply by sending an informal request by email to [email protected].

Storage times

Without prejudice to the details set out in the respective information, the data retention times are as follows:

  1. Personal data for registration for information or contact requests: time required to process the request.
  2. Subscription to newsletters and authorization to marketing communications: until consent is cancelled and in any case no later than two years of inactivity.
  3. Sending applications: for a maximum of three months after any notification of rejection. This period allows the Data Controller to defend itself and justify its choice if an action is brought against it for failure to hire due to discriminatory reasons pursuant to the Federal Act on Gender Equality (Art. 8 para. 2 in conjunction with Art. 5 para. 2 LPar). Marketing: until consent is cancelled and in any case no later than two years of inactivity.

Treatment Methods

The processing of the interested party’s data may be carried out both on paper and with the aid of computerised means and may consist of any operation or set of operations among those indicated in art. 5 letter d) of the LPD and art. 4, paragraph 1, point 2 of the GDPR and will always be based on the principles of lawfulness, correctness, transparency, limitation of purposes and conservation, minimisation, accuracy, integrity and confidentiality.

Auxilia Real Estate Sagl guarantees the logical and physical security of the data and, in general, the confidentiality of the personal data processed, implementing all the necessary technical and organizational measures adequate to avoid the loss, illicit or, in any case, incorrect use of the same, as well as unauthorized access by third parties.

Data communication

The personal data processed for the purposes indicated may be communicated to:

  1. to the Data Controller’s employees and collaborators, who will act in their capacity as authorised data processors (or so-called “data processors”) as well as to other companies of the Auxilia SA Group and/or consultants who need to process them in order to carry out their duties;
  2. to third parties who carry out outsourcing activities (consultants, banks, freight forwarders, etc.) on behalf of the Data Controller by providing specific services which, depending on the case, may assume the role of Data Processors, Joint Controllers or Independent Controllers;
  3. to judicial or supervisory authorities, administrations, public bodies and organizations (national and foreign), in compliance with the provisions of the law and following a formal legitimate request by such entities.

The complete and updated list of Data Controllers is kept at the headquarters of Auxilia Real Estate Sagl and is available to interested parties who may request it in writing, indicating the reasons and their legitimacy. For IT security reasons, some information may be anonymized or masked.

Transfer of data abroad

Your Personal Data is currently processed in archives or servers located at the headquarters of the Company Auxilia Real Estate Sagl or in any case in Switzerland. The data may be transferred to foreign countries where other offices of the Data Controller or other companies of the Auxilia Group are located. The transfer to countries outside the European Union may only take place in the presence of a level of protection deemed adequate as per the list reported in Annex no. 1 OPDa (Ordinance on the protection of data of the Swiss Federal Council – RS 235.11) or in any case on the basis of other appropriate guarantees such as for example the Swiss-U.S. data privacy framework (DPF). The interested party has the right to obtain a copy of such guarantees, as well as the list of countries to which the data has been transferred by writing to the address [email protected].

Rights of the interested party

The interested party at any time, by sending a specific request to the Data Controller at the ordinary and electronic mail addresses indicated above, may exercise the rights recognized by the LPD and where applicable by the GDPR, summarily listed below:

  1. right to access or obtain confirmation as to whether or not data concerning you is being processed (art.25 para. 2 LPD);
  2. the right to have data delivered to you or to request its transmission to third parties (art. 28 LPD);
  3. right not to be subjected to automated decision-making processes (Article 21, paragraph 2, LPD);
  4. request that inaccurate data be rectified (Art. 32 para. 1 LPD);
  5. request that a certain processing of personal data or a certain communication to third parties be prohibited (Art. 32 para. 2 LPD);
  6. request that your data be deleted or destroyed (art. 32 para. 2 LPD).
  7. The exercise of these rights generally requires that you provide proof of your identity (for example, a copy of your identity document). To exercise your rights, you can contact us at the postal address of the Owner or at the email address [email protected].

If the data processing falls within the territorial scope of application referred to in art. 3 GDPR, the interested party may assert the rights as expressed in art. 15-22 GDPR, by contacting the Data Controller or his representative in the European Union. The user has the right, at any time, within the limits and under the conditions established by the GDPR, to request access to his personal data, rectification, erasure of the same, limitation of the processing concerning him or to oppose their processing as well as to exercise the right to the portability of such data.

In the event of violations, the interested party may contact the Federal Data Protection and Information Commissioner (FDPIC – https://www.edoeb.admin.ch/edoeb/it/home.html) or, for those who fall within the scope of application of the GDPR, the national supervisory authority of the member state where the violation occurred.
